Getting Started
To get started with your rental plan, or to change your existing plan, simply choose a plan above and complete the options below. Please take the time to read and understand all of the terms and conditions of the rental plans.

Cancellation
You can easily cancel your membership anytime, online, 24 hours a day. There are no cancellation fees. Rental plans are renewed on a monthly basis. When you cancel your plan, you are essentially choosing to not renew it in the future. You would still be able you use your existing plan until it expires.

Terms and Conditions

To fairly resolve any disputes arising between Member and DVD and Game Depot, LLC. regarding Member's membership, account, fees, and any transaction with DVD and Game Depot LLC, or any DVD and Game Depot policies, Member and DVD and Game Depot LLC, agree that any claims of these types by either you or DVD and Game Depot LLC, shall be settled exclusively by binding arbitration governed by Arizona law and administered by the American Arbitration Association under its rules for the resolution of consumer-related disputes, or under mutually-agreed procedures. Because this method of dispute is personal, individual, and provides the exclusive method for resolving such disputes, Member further agrees that he/she will not participate in a class action or class-wide arbitration for any claims covered by this agreement.

Member acknowledges that the rental plan listed above will renew on the same day of each month, or the last day of the month, which ever comes first. Member acknowledges that the rental plan payment will be charged to their default credit card listed above. Member acknowledges that the member can change their rental plan at any time, but will forfeit any pre-paid payments and will be charged for the new plan at the time the plan is changed. Member acknowledges that the member can can cancel their plan at any time. Member acknowledges that each rental item is due back at the date stated on the transaction receipt and must be returned to the DVD and Game Depot store from which it was rented. Member acknowledges that the rental material will be returned in the same condition as when it was rented. Member acknowledges that member will be charged for material returned damaged. There is no additional rental charge if Member keeps a rental item beyond the pre-paid rental period. However, Member acknowledges and agrees that if Member chooses to keep a rental item more then five (5) days after the end of the rental period, DVD and Game Depot will automatically convert the rental to a sale on the sixth (6th) day after the end of the rental period. DVD and Game Depot will charge the membership account holder's credit card the selling price for the item, which is either (1) the retail price charged by DVD and Game Depot for the product if sold as new, if the product is not available for sale as previously rented product, or (2) the selling price charged by DVD and Game Depot for the product if sold as previously rented product, if the product is available for sale as previously rented product, plus the cost of the rental lock box. DVD and Game Depot reserves the right to change these terms, generally and specifically with regard to this paragraph, at any time without notice.

Member acknowledges that he/she has received and read a copy of the Terms and Conditions for DVD and Game Depot membership and agrees that the membership card(s) issued by DVD and Game Depot will be used only as provided in these Terms and Conditions. DVD and Game Depot reserves the right, at anytime and without notice, to amend the Terms and Conditions of membership. MEMBER ACKNOWLEDGES AND ACCEPTS FULL RESPONSIBILITY AND GUARANTEES PAYMENT FOR ALL ITEMS RENTED THROUGH THE USE OF THE MEMBERSHIP, WHETHER OR NOT SUCH USE IS AUTHORIZED BY MEMBER. Member agrees that DVD and Game Depot LLC may pursue all avenues of collection, including use of collection agencies, and authorizes DVD and Game Depot LLC to prepare and submit credit card charges using any of the credit cards listed above, or attached to the member's account, to recover all charges and all other unpaid amounts due to (a) Member's failure to timely return all items rented through the membership, (b) damages to returned items (not to exceed the retail price of the item), and (c) other unpaid charges and reasonable legal fees resulting from the failure to return rented items.

Member must notify DVD and Game Depot immediately by telephone and in writing if his/her membership card(s) is lost or stolen, or if changes to the "Authorized Users" need to be made. Member is responsible for all use of the membership card(s) and "Authorized Users" prior to receipt by DVD and Game Depot of written notice of the change. Failure to notify the DVD and Game Depot may result in the posting of significant charges to the credit cards listed above.

Except as provided above in "Communication", Member authorizes DVD and Game Depot LLC, and its affiliates to share information contained in this Application or generated by use of the membership and to use such information in the ordinary course of their business, including (a) marketing purposes, (b) account maintenance and debt collection, and (c) information technology services. You may opt out of receiving marketing communications from DVD and Game Depot LLC, and its affiliates. To do so, contact your DVD and Game Depot store.
